Abstract

El avance en el conocimiento de la genética y la tecnología para interpretar, multiplicar y utilizar material e información genética ofrece nuevas opciones para entender la etiología y el tratamiento de enfermedades. La genética también ha tenido aplicaciones en investigaciones orientadas a determinar los orígenes y tendencias migratorias de grupos humanos al igual que responsabilidades individuales en casos judiciales. Estos múltiples usos subyacen a la creación incesante de bases de datos genéticos humanos, en cuya operación se colecciona, almacena transfiere información genética a una escala sin precedentes. Esta tendencia tecnocientífica pone en tensión la normatividad y los supuestos éticos imperantes. En este documento se analiza la protección de derechos individuales y colectivos en Colombia frente al establecimiento de biobancos genéticos humanos. / Advances in genetics and its technology to interpret, multiply, and use material and genetic information offer new options for understanding the etiology and treatment of diseases. But genetics also has applications in human population studies regarding the origins and migration patterns of human groups as well as investigations for individual responsibilities in court cases. These many uses explain the incessant creation of human genetic databases, whose operation implies the collection, storage and transference of genetic information to an unprecedented scale. This techno-scientific trend questions the existing regulations and prevailing ethical assumptions. This paper analyzes the protection of individual and collective rights in Colombia given the establishment of human genetic biobanks.
